Please read these Official Rules carefully before entering the KONG Day Peel Tab Sweepstakes (“Sweepstakes”). By entering the Sweepstakes, you agree that you have read, and are bound by the terms and conditions set forth below as if you had signed a written contract. If you do not agree to the terms and conditions set forth below, you may not enter the Sweepstakes.
Void Where Prohibited or Restricted by Law: All federal, state, and local laws and regulations apply to the Sweepstakes. The Sweepstakes is void in any state or local jurisdiction where it is prohibited or restricted by law or regulation.
No Purchase Necessary, No Cost to Play: There is no cost to participate in the Sweepstakes or to win a Prize.
Sponsor: The Sweepstakes is sponsored by The KONG Company LLC, 16191 Table Mountain Pkwy, Golden, CO 80403. No other company is responsible for this Sweepstakes or the award of the Prize(s).
Eligibility: The Sweepstakes is only open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age (nineteen [19] if a resident of Alabama or Nebraska) or older as of July 28, 2024. Void elsewhere and where prohibited by law. Employees, contractors, officers and directors of the Sponsor, their respective parent, affiliate and subsidiary companies, distributors, suppliers, and the immediate family members (spouse, parent, child, sibling, grandparent, grandchild, and/or “step” of each, regardless of where they reside) and those living in the same households (whether related or not) of any of the above are not eligible to participate in the Sweepstakes or to win a Prize. Any entry by a person not deemed to be eligible, or not submitted in strict compliance with these Official Rules shall be considered void and the entrant, whether eligible or not, shall be disqualified.
Sweepstakes Timing: The timing of the Sweepstakes is as follows: Purchases of specially marked classic shaped KONG toys must be made between July 28, 2024 and September 15, 2024, while supplies last (“Purchase Period”). Prize Claims must be made between 12:00 a.m. (midnight) Mountain Time (“MT”) on July 28, 2024 and 11:59 p.m. MT on September 15, 2024 (“Prize-Claim Period”). The Sponsor shall be the official time-keeper of the Sweepstakes.
Sweepstakes Description/How to Enter: No purchase is necessary to enter or win the Sweepstakes. There are two (2) ways to play:
Purchase a specially-marked classic shaped KONG toy During the Purchase Period, and while supplies last, purchase any specially-marked KONG toy. Next, peel back the KONG Day tab and look underneath it to see the KONG Day Sweepstakes message inside. If you find a message that reads, “You’re a winner! Your code: xxxx” you have won a prize (subject to verification). Save your Peel Tab and product receipt, as it may be required for validation purposes. To find out which prize you have won (subject to verification), scan the QR code with your smartphone or go to www.kongcompany.com/kongday-legal/ to enter your winning code as shown on your Peel Tab during the Prize-Claim Period. Next, enter your prize code to see what prize you’ve won and then follow the instructions to claim your prize (a “Prize Claim”). All Prize Claims may be subject to verification, including proof of Peel Tab and product receipt.
Online Write-in Method. Participants may go to www.KONGCompany.com/kongday-nominateashelter/ to enter the KONG Day Sweepstakes through the Online Write-in Method. Follow the directions on the link to enter the Sweepstakes, providing all required information. For each Online Write-in entry, a specially-marked KONG Day Classic toy package will be selected by a KONG Employee and opened by peeling back the KONG Day tab and determining if the toy contains a winning tab. Winning participants will be notified and receive a prize from KONG. Non-winning participants will not receive a reply. All Write-in participants have the option of nominating a rescue group or shelter to receive a KONG toy donation on behalf of The KONG Company, however, making a nomination is not a condition to participate.

Regardless of your participation method ([a] or [b] as stated above), if you do not find a winning tab, you are not a prize winner. Only official, verified winning tabs are considered winners, if properly claimed as described above and verified as valid by the Sponsor. It is recommended that you keep your winning Peel Tab for your records.
Odds of Winning: Winning KONG Day packages, 24, will be randomly distributed amongst 35,800 Specially-marked classic shaped KONG toys with the Sweepstakes concluding upon the redemption of the final winning Peel Tab, or by end of Prize-Claim Period, whichever is earlier. All Prizes will be awarded provided they are claimed properly in accordance with these Official Rules.
The Prizes: Up to 24 will be awarded. The Prizes include: 24 KONG Day gift baskets including special KONG Day merchandise (in the selected size of winning participant) KONG toys, and KONG treats, valued at $200.00 each. One prize per verified prize winner.
Prize Winner Responsible for All Associated Costs: Each Prize winner is responsible for all costs associated with accepting the Prize, including taxes, government surcharges, fees or expenses. Additionally, the Prize winner is responsible for any other related costs or expenses related to the use of the Prize.
No Substitution of Prize. If a Prize is not claimed by a Prize winner within the Sweepstakes Period, it will be forfeited. Sponsor will not permit substitution, transfer or payment of a cash equivalent for a Prize except that the Sponsor, in their sole discretion, may substitute a Prize with a Prize of equal or greater value, as a result of the unavailability of the Prize or any component thereof, or for any other reason.
Publicity Release. Except where prohibited by law, a Prize winner’s entry and/or acceptance of a Prize constitutes permission of the Prize winner for Sponsor to use, without notice or further compensation, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised, such Prize winner’s name, likeness, pictures, photographs, voice, biographical information, and statements for purposes of advertising, promotion, and publicity, including on social media.
General Conditions of Participation in This Sweepstakes: In the event there is a discrepancy or inconsistency between disclosure or other statements contained in any Sweepstakes related materials or notifications, or made by Sponsor or its representatives, and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. Sponsor may modify and amend these Official Rules for clarification purposes only, provided the material terms and conditions of these Official Rules are not affected by such modifications/amendments. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be constructed in accordance with their terms and if the invalid or illegal provision were not contained herein. Sponsor is not responsible for human, printing, distribution or production errors, including but not limited to errors in/on Peel Tabs. Any Peel Tab that is tampered with, illegible, mutilated, reproduced, contains printing or other errors, is obtained where prohibited or not obtained legitimately, will be null and void. If, due to an administrative, human, printing, technical production or other error, more prize-winning message are issued for any particular prize, causing more of such prizes to be claimed than are intended to be awarded according to Rule 8, the intended number of such prizes will be awarded in a random drawing from among all recipients of a verified winning Peel Tab for that particular prize. In no event will Sponsor be obligated to aware more than the stated number of prizes.
Disclaimers: Sponsor shall not be responsible or liable for: (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions of Prize claims; (b) any unauthorized access to, or theft, destruction or alteration of Peel Tabs at any point in the operation of the Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or Website or any combination thereof; (e) suspended or discontinued Internet or wireless service; (f) typographical, human or other errors in the offer or administration of the Sweepstakes, including but not limited to errors in advertising, the Official Rules, on Peel Tabs, in the determination and announcement of prizes/winners and/or in the distribution of any prize or prize messages; or (g) cheating or fraud by any participant or other individual.
Disputes and Interpretation of Official Rules: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules (whether of Colorado or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than Illinois. By participating, participants agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal, state or local court located in Jefferson County, Colorado; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will participant be permitted to obtain aware for, and participants hereby waive all rights to claim punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
SOME JURISICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENT DAMAGES, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU.
Rules/Winner Information: The identity of the Prize winners and/or a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to the Sponsor at: 16191 Table Mountain Pkwy, Golden, CO 80403.
Privacy and Collection of Information: Any personally identifiable information collected in connection with a participant’s participation in the Sweepstakes will be used by Sponsor, its affiliates, agents and marketers only for purposes of the proper administration and fulfillment of the Sweepstakes, as described in these Official Rules, and in any manner consistent with Sponsor’s Privacy Policy, available at https://www.kongcompany.com/terms-of-use/. Winner’s names may be included in a publicly available winner’s list.
